Acceptable Use Policy
This Acceptable Use Policy (“AUP”) governs the use of the Digital Wellness Platform and Services. We may modify the AUP at any time upon written notice.
Subscriber and End Users shall not use, facilitate or allow others to use the Services:
· For any illegal or fraudulent activity, including but not limited to counterfeit goods and services, drugs and controlled substances, human smuggling or trafficking, products made from endangered or protected species, sexual services, gambling, betting or wagering activities, unauthorized, multi-level marketing businesses, stolen goods, or content related to weapons including firearms, ammunition and explosives that takes place out of a safe or controlled environment;
· To violate the rights of others;
· To threaten, incite, promote or actively encourage violence, terrorism or other serious harm, which includes but is not limited to such behavior on the basis of race, ethnicity, national origin, caste, sexual orientation, gender, gender identity, religious affiliation, age, disability, or serious disease;
· For any activity that promotes or actively encourages child sexual exploitation or abuse;
· To violate the security, integrity, or availability of any user, network, computer, or communications system, software application, or network or computing device;
· To distribute, publish, send, or facilitate the sending of unsolicited mass email or other messages, promotions, advertising, or solicitations (“spam”);
· To engage in the targeted harassment of anyone else, or to encourage others to engage in such targeted harassment;
· To engage in the abuse of anyone else, which includes any attempt to harass, intimidate, or silence another person’s voice;
· To upload or distribute content without having the right to transmit such content under any law, including trademark and copyright law, or under contractual and fiduciary relationships;
· To defame, impersonate, or use anyone else’s name or image without permission;
· To post other people’s private information without such person’s express permission, or to get others to do so, which includes home address or physical location, identity documents including government issued IDs and social security or other national identity numbers or photo images of any of the foregoing, contact information including non-public personal phone numbers or email addresses, financial account information, and other private information such as biometric data or medical records;
· To engage in hateful conduct, including posting or sending hateful imagery, making violent threats, or targeting others with hateful or abusive speech, including profanity, or encouraging anyone else to do the same;
· To threaten or call for violence, serious hard, death, disease to an individual or group of people;
· To share or publish sensitive content, including content that depicts or promotes graphic violence, adult content, gratuitous gore, hateful imagery, and child exploitation material; and/or
· To share or publish content that promotes suicide or self-harm.
We (as well as our service providers) may monitor the account and conduct of each subscriber, and investigate any suspected violation of this AUP and remove, disable, or limit access or availability to any content, resource, or account that violates this AUP, or that we consider in good faith to violate this AUP.
We and/or our service providers may also permanently suspend an account that violates this policy. Subscriber and End Users agree to cooperate with us and our service providers to remedy any violation.
When determining whether there has been a violation of this AUP, we may consider a subscriber or an end user’s ability and willingness to comply with this Policy, including the policies and processes in place to present or identify and remove any prohibited content or activity.
